Parcheggio bici sul marciapiede: multa?

Fermare la bicicletta per recarsi in ufficio pubblico, come ad esempio quello delle poste, oppure per recarsi a casa dell’amico o al lavoro è dunque sempre più frequente. Tuttavia non sempre c’è un’area privata in cui metterla. Allora è legittimo chiedersi se è possibile lasciare il mezzo all’esterno sul marciapiede, magari legato ad un cartello stradale, senza rischiare una multa.

Va rimarcato che il Codice della Strada – fonte di riferimento anche per quanto attiene alla circolazione con biciclette – chiarisce la questione del parcheggio bici sul marciapiede. E lo fa inserendo la bicicletta nella categoria dei “veicoli”. Pertanto anche il ciclista è tenuto, al pari di un automobilista, al rispetto delle norme delle circolazione dei veicoli a quattro ruote. In particolare, rileva l’art. 158 CdS, inerente il divieto di fermata e di sosta dei veicoli: in esso troviamo un elenco tassativo in cui soste e fermate sono vietate, in corrispondenza ad esempio delle strisce pedonali o delle curve e dossi, ma anche sui marciapiedi (salvo diversa segnalazione). E dato che le biciclette sono da considerarsi “veicoli”, analogamente ad automobili e camion, ne consegue che anche per i ciclisti valgono le stesse prescrizioni. Anzi, in caso di violazione, scatta la multa oscillante da un minimo di 84 euro ad un massimo di 335 euro. 

Tuttavia, sono in arrivo importanti novità in proposito. È però alle porte una nuova normativa riguardante il parcheggio bici su marciapiede. Infatti, con tutta probabilità entro qualche mese – dopo l’ordinario iter in Parlamento – entrerà in vigore un nuovo testo che ha già ricevuto l’ok della Commissione Trasporti della Camera. In esso è prevista una maggior indulgenza verso i ciclisti, dato che verrebbe consentito il parcheggio bici sul marciapiede, a patto che nei pressi del luogo di parcheggio non vi siano le apposite rastrelliere cui apporre il mezzo e che la bicicletta non renda più difficoltoso il passaggio ai pedoni (pensiamo ad esempio al caso di un marciapiede molto stretto, in cui è impossibile lasciare la bici, senza che i pedoni non debbano scendere dal marciapiede per oltrepassarla).
In conclusione, la scelta verso cui sembra si stia orientando il legislatore, è proprio quella di trovare un compromesso tra regole stradali e abitudine dei ciclisti di lasciare la bicicletta sul marciapiede, appoggiata su qualche muretto o cartello stradale. Per evitare la multa, sarà però necessario ricordarsi delle due condizioni appena menzionate.

It should be noted that the Highway Code - a reference source also with regard to traffic with bicycles - clarifies the issue of bicycle parking on the sidewalk. And it does so by placing the bicycle in the category of "vehicles". Therefore also the cyclist is obliged, like a motorist, to respect the rules of circulation of four-wheeled vehicles. In particular, notes the art. 158 CdS, concerning the ban on stopping and stopping vehicles: in it we find a mandatory list in which stops and stops are prohibited, for example at the pedestrian crossings or bends and bumps, but also on the sidewalks (unless otherwise indicated) . And since bicycles are to be considered "vehicles", similarly to cars and trucks, it follows that the same provisions also apply to cyclists. Indeed, in case of violation, the fine oscillates from a minimum of 84 euros to a maximum of 335 euros.

 However, important news is on the way. However, a new regulation regarding the parking of bikes on the sidewalk is just around the corner. In fact, in all probability within a few months - after the ordinary procedure in Parliament - a new text will come into force which has already received the OK from the Chamber Transport Commission. In it there is a greater indulgence towards cyclists, since bicycle parking on the sidewalk would be allowed, provided that there are no special racks to place the vehicle near the parking place and that the bicycle does not make it more difficult to pass pedestrians (think for example of a very narrow sidewalk, where it is impossible to leave the bike, without pedestrians not having to get off the sidewalk to cross it).


In conclusion, the choice towards which the legislator seems to be moving is precisely to find a compromise between road rules and the habit of cyclists to leave the bicycle on the sidewalk, resting on some wall or road sign. To avoid the fine, however, it will be necessary to remember the two conditions just mentioned.
