Incidente con bicicletta: quali conseguenze

Esistono tre tipi di responsabilità per chi guida una bici, responsabilità che possono concorrere nello stesso momento.

C’è, innanzitutto, la responsabilità amministrativa. Gran parte delle norme del Codice della strada si applicano anche ai ciclisti, sicché questi ultimi devono rispettare le regole di prudenza, la precedenza e il divieto di superare i limiti di velocità o di circolare in stato di ebbrezza. In caso contrario, scattando le comuni “multe” stradali.
Da un punto di vista civilistico, invece, esiste una norma generale contenuta nel nostro Codice civile in forza della quale chiunque procuri un danno ad altri – anche se involontariamente – è tenuto a risarcirlo e, a tal fine, risponde delle conseguenze con tutto il proprio patrimonio. Ciò implica l’obbligo per il ciclista che investe un pedone o un altro ciclista di pagare i danni arrecati al terzo; se non lo fa, può subire una causa civile, una condanna e il successivo pignoramento dei beni.
Sotto un profilo penale, infine, si risponde del reato di lesioni colpose (lievi, gravi e gravissime). Anche in questo caso, non importa se il danno è stato causato senza alcuna intenzione. Tuttavia, il reato scatta non per qualsiasi tipo di lesione (ad esempio una sbucciatura del ginocchio) ma solo per quelle ferite che comportano una imitazione funzionale o un significativo processo patologico ovvero una compromissione delle funzioni dell’organismo, anche non definitiva, ma comunque significativa . In buona sostanza, anche il reato di lesioni lievi non scatta per qualsiasi tipo di ferita ma solo per quelle più consistenti. In questo, ha fondamentale importanza il certificato medico rilasciato al pronto soccorso e i giorni di prognosi in esso riportati.

Finally, from a criminal point of view, we are responsible for the crime of negligent injuries (slight, serious and very serious). Again, it does not matter if the damage was caused without any intention. However, the crime is triggered not by any type of injury (for example a knee peeling) but only for those wounds that involve a functional imitation or a significant pathological process or an impairment of the organism's functions, even if not definitive, but still significant . Basically, even the crime of minor injuries does not occur for any type of injury but only for the most consistent ones. In this, the medical certificate issued to the emergency room and the prognosis days reported in it are of fundamental importance.
